Who counts toward the 5 employee threshold?

Everyone on payroll, including part-time and temporary workers, and in most cases independent contractors count toward the headcount even though they are not the ones being trained.

Organizations sitting at three or four employees cross the line faster than they expect. The obligation attaches once you hit five, not at the start of the next year.

What happens if training is not done?

The Civil Rights Department can order compliance, and the bigger exposure shows up in litigation. An employer that skipped required training has a harder time defending its response when a complaint arrives.

The practical risk is not a fine. It is losing the argument that you took reasonable steps.

Does an online course satisfy the requirement?

A compliant online course can satisfy the statute. It rarely changes what a manager does at 4:45 on a Friday when somebody tells them something.

Self-paced training finishes at 10% to 20% generally (Ruzuku, State of Online Courses 2026). The record gets created either way. The behavior usually does not.
